COVID-19: Intervention needed in waiving school fees- (Blog)


Children are the backbone of the country, and if we look around 60% of the total population of the children in India they are studying in Private schools in the country.

In Writ Petition (C)  No. 4011/2020, Queen Mary School Northend Vs Director of Education ,  Hon’ble Justice Jayant Nath ordered  to issue notice to Director of Education and even observed that the petitioner can decline to supply ID and Password for online education facility for the scholars who haven't paid the fees for quite two months and even observed that oldsters can approach appropriate authority for the action of the varsity. This created havoc within the minds of oldsters of the youngsters and thus need for urgent government intervention on the difficulty.

On 21st March, 2020 public Curfew was enforced within the country to combat the present Covid 19 issue.  Indian Government  under Prime Minister Shri Narendra Modi supervision ordered a nationwide lockdown for 21 days as a precaution against the coronavirus pandemic in India. This lockdown was further extended from time to time and still the education Institutes/School aren't allowed to open. The parents face financial crises thanks to their business and services being affected. Even because the scholars are reception only and not getting to school, the oldsters aren't paying the varsity fees. The school authorities, on the opposite hand, are required to pay monthly salaries for the teaching and non-teaching staff even during the lockdown. Even the upkeep expenditure is additionally borne by the institutions. Moreover, the faculties and Institutions need to incur additional expenses for fixing E-learning modules within the school and getting their teachers trained for an equivalent.

Though the varsity has started conducting online education for the scholars and have developed the specified infrastructure and trained their teachers for an equivalent. The Government has instructed the varsity authorities to open the regular school only when they get some intimation thereto effect from the govt. authority, so presently the varsity is functioning through online mode.

In Writ Petition (C) no. 2993/2020 the division bench by its judgment had stated that this provision shouldn't be misused and it might be necessary for the oldsters seeking advantage of this relief to determine to the satisfaction of the varsity authorities or the director of education due to the lockdown, they're actually financially incapacitated from paying the schooling fees. The order of the Hon’ble court needs clarification/ interpretation because the oldsters are misusing an equivalent.

It can't be questioned that children are amongst the foremost vulnerable sections in any society. They represent almost one-third of the world’s population and unless they're given proper opportunities, the chance of creating them grow into responsible citizens of tomorrow will slip out of the hands of present generation ” The said observation made in Salil Bali………Vs……..Union of India and Anr., 2013(VII|) AD (SC) by the Supreme Court shows that it's our obligation to the young generation to open up all opportunities including education for each child to unfold its personality and rise to its full stature, physical, mental, moral and Spiritual. Article 45 of the Indian Constitution clearly says that it’s the joint responsibility of the Central and State to supply free and compulsory education.

The documented Kothari Commission, 1964-66 recommended that the Central Government should undertake the responsibility in education for the equalization of educational opportunities with special regard to the reduction of inter-state differences.  We have to guard private schools from closing and even not deprive the scholars from education. The conflict of selections of varied supreme court and it being Policy decision many high courts have asked the oldsters to approach the acceptable authority for an equivalent, i.e. the govt.

The Union government or government should urgently take up the difficulty and plan a technique or policy wherein interest free loans are often provided to the oldsters for paying the fees or some financial assistance is given to the varsity authorities in order that they will meet their expenses in spite of non payment of fees. Governments act as long as people demand. It's observed by us, therefore the parents associations within the entire country should take up the difficulty with the govt and force them to intervene.
