‘POLICE’ – GUARDIANS OR BARBARIANS IN THE CRIMINAL JUSTICE ADMINISTRATION? (Blog)
The Machinery of ‘Police’ was established to
protect the people and give them a sense of security while living in the
society. This is the intent to create such a machinery in the State but in
reality are the pubic ready to approach the Police when they need to be secure
or are they frightened? In most cases, the latter is the answer. The Public
(Commoners) are afraid of their lives to approach the police because of some of
the most inhuman barbaric acts committed by the Police, the most recent one (June
19-23, 2020) which this blog focuses is the one in Sathankulam Town, Thootukudi
District, State of Tamil Nadu, India.
The only fault on the side of the
two innocent men who owned a mobile phone showroom was to have kept it
open for a slightly very negligible amount of time over and above the
stipulated lockdown guidelines which is in place to curb the COVID-19 Pandemic[1].
The duo, a father and son, were brutally killed in police excess whereby there
was rampant human rights violation on the duowho could be equated to front
line warriors helping the public to buy mobile phones in times of dire
communication needs.
The Law says you could use nominal
force as ‘Self-Defence’ in case you are being threatened and there is
eminent danger to your life by the act of another. But, in this case was the
force used proportional to the act committed? Not at all. Police used excess
force and tortured the two innocent menphysically, mentally & sexually and
deprived them of all due process of law whereby they could get a lawyer to
defend themselves – which opportunity was not accorded to them, instead
they were locked up in Kovilpatti Sub Jail (some 100 kms from
Sathankulam Town) and tortured in a manner no human would ever think of.
The pain they underwent for doing social service throws light on the high-handedness
of the Police Force who instead of protecting the public as Guardians act
as Barbarians who use this opportunity to vent out their frustration and commit
a Crime of Murder by themselves.
This case has to be tried very soon
and the culprits have to be brought to books and meted out the maximum Capital
punishment under our relevant penal laws to and strict circulars in this
regard must be sent out to all police stations to be followed in letter and
spirit to not use any kind of force while enquiring or at any stage of
the Criminal Case. The use of ‘lathis’ should be banned at all costs as it
inflicts pain and sufferings on Human Beings which may be irreversible for some
depending upon their Health conditions. Such rampant brutal killings cannot be
seen and kept quiet by us one and all.
May we stand for Justice for the
departed innocent souls and book the culprits under Law at the earliest.
